Terms of Use

1. Purpose
These Terms of Use (hereinafter the "Terms") govern access to and use of the Cortifit mobile application (hereinafter "the Application"), published by AMBAVILLE.
By downloading, installing or using the Application, the user (hereinafter "the User") accepts these Terms without reservation. If the User does not accept these terms, they are invited not to use the Application.
2. Description of the Application
Cortifit is a well-being application offering a 30-day protocol combining breathing exercises, anti-inflammatory nutrition recommendations, sleep tracking and daily routines. The Application allows users, among other things, to track their mood and stress level, to perform vagal stimulation and grounding exercises, to read educational articles on cortisol management and to view their health data from Apple Health or Google Health Connect.
3. Health disclaimer
The Application is a general well-being tool and in no way constitutes a medical device, a diagnostic tool, a treatment or medical advice. The information, recommendations and exercises offered in the Application are provided for informational and educational purposes only.
The User acknowledges that the Application does not replace a medical consultation. In the event of a health problem, persistent symptoms or any doubt, the User is invited to consult a qualified healthcare professional. The Publisher disclaims all liability in the event of inappropriate use of the Application or of medical decisions taken on the basis of its content.
4. Registration and user account
To access all of the features, the User must create an account by providing an email address and a password, or by using authentication via Apple or Google.
The User undertakes to provide accurate information and to keep their credentials confidential. Any activity carried out from their account is deemed to have been performed by them. In the event of unauthorized use of their account, the User must inform the Publisher without delay.
The Publisher reserves the right to suspend or delete an account in the event of a breach of these Terms, without notice or compensation.
5. Premium subscription
The Application offers a free version with limited features and a Premium version available by subscription, at a price of €9.99 per month or €59.99 per year. Prices are stated in euros, all taxes included.
The subscription is taken out and billed through the App Store (Apple) or the Google Play Store (Google). Payment is processed by the corresponding platform under its own terms.
The subscription renews automatically at the end of each period, unless canceled by the User at least 24 hours before the renewal date.
The User may cancel their subscription at any time from their App Store or Google Play Store account settings. The cancellation takes effect at the end of the current period.
Refund requests must be addressed directly to Apple or Google, depending on the platform used.
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content whose performance has begun with the express agreement of the User.
6. Intellectual property
All the elements of the Application (texts, images, illustrations, exercises, recipes, articles, design, source code, logos, trademarks) are the exclusive property of the Publisher or of its partners and are protected by intellectual property laws.
Any reproduction, representation, modification, distribution or exploitation, in whole or in part, of these elements without the prior written authorization of the Publisher is strictly prohibited.
7. User-generated content
The User retains ownership of the data they enter in the Application (journal notes, check-in answers, morning intentions, etc.). By using the Application, the User grants the Publisher a non-exclusive, free of charge license limited to the provision of the service.
8. Health data and integrations
The Application may connect to Apple Health (iOS) or Google Health Connect (Android) to read data such as step count, distance covered, calories burned and sleep data. This data is processed on the User's device and transferred to the Publisher's servers only after separate, explicit consent, under the conditions described in the Privacy Policy (section 3b).
Connection to these services is optional and initiated by the User. The User may revoke these authorizations at any time in their device settings.
9. Availability and changes
The Publisher endeavors to keep the Application permanently accessible but does not guarantee uninterrupted operation. Access may be temporarily suspended for maintenance or update reasons, or in the event of force majeure.
The Publisher reserves the right to modify, suspend or discontinue all or part of the Application at any time.
10. Liability
The Application is provided "as is". The Publisher may not be held liable for direct or indirect damages resulting from the use of, or the inability to use, the Application.
The Publisher's liability is limited to the amounts actually paid by the User in respect of the subscription over the last 12 months.
11. Amendment of the Terms
The Publisher reserves the right to amend these Terms at any time. The User will be informed of any substantial change by a notification in the Application.
12. Termination
The User may stop using the Application and delete their account at any time from the settings of the Application. Deleting the account entails the irreversible deletion of all associated data, subject to legal retention obligations.
13. Governing law
These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution.
In accordance with the provisions of the French Consumer Code, the User is informed that they may refer the matter to a consumer mediator (médiateur de la consommation).
